Drafting and Serving a Section 21 Notice

A Section 21 Notice (or Notice to Terminate) gives the tenant 2 months notice to vacate the property and is appropriate where;

  • there is a valid Assured Shorthold Tenancy Agreement
  • the fixed period of the tenancy has expired or is due to expire
  • you do not want/need to recover rent arrears (or are happy to recover them in separate proceedings)

    The advantages of serving this Notice are;

  • there is no need to prove any 'ground' to end the tenancy
  • if the tenant does not leave you can use the accelerated possession procedure

    It is essential that the Notice is drafted correctly and is compliant with the latest regulations. Any error is likely to cost you serious delay in evicting the tenant.

    We will advise you on your position and draft the Notice. This will then be served, normally by first class post recorded delivery. You will be provided with a copy of the Notice + proof of posting.
