We are specialists in leasehold enfranchisement.
This service is for Landlords who have received an application to extend a lease from their tenant. Your costs will generally be paid by the tenant.
We have access to and regularly instruct a range of specialist Royal Institute of Chartered Surveyors qualified surveyors who can be instructed on your behalf as appropriate (at the Lessees cost) to value the premium payable to you.
Our approach is one of closely scrutinising all Notices to establish validity and ensuring the Landlord receives the maximum compensation.
If a Notice is invalid a negative Counter Notice can be served thereby defeating the tenants claim and retaining value in the portfolio until another Notice is served. Once a Lessee serves a Notice of Claim the Lessee automatically becomes liable for the Landlords cost of dealing with the Claim (except LVT proceedings). It is our policy to obtain statutory deposits wherever possible from Lessees after a Notice of Claim has been served.
This is done to indemnify the Landlord for the costs of the Claim as far as possible. Generally speaking the costs of the Claim are payable by the Lessee on completion of the Lease.
